Terms and Conditions
Services and Terms of Engagement
Declutter & Organise with Care offers services to satisfy your organising requirements as stated in our first conversation and email of confirmation. As the success of our services depends on your cooperation, we are not liable if your lack of cooperation results in needs or expectations not being realised.
Your choices, as well as the quantity and complexity of the work being done, will determine how quickly and successfully the process moves forwards.
Confidentiality.
Any personal or private information received from you will be kept confidential. Without your consent, we agree not to remove confidential information from your possession. Declutter & Organise with Care will offer you written action plans, but these are confidential and must not be used or shared with anyone else without our permission.
Insurance
Even though we take special care to prevent accidental damage to your belongings or property while performing our services, we have liability insurance, should accidental damage occur.
When our representatives are on your property, you are responsible for any injuries they sustain as well as any loss or damage to their property. You are also in charge of implementing all necessary safety measures to ensure the protection of Declutter & Organise with Care personnel while they are on your property.
Safety
Declutter & Organise with Care representatives cannot work in squalid conditions or where there is the odour of cigarette smoke, food waste, human or animal waste, mould or pathogens. Declutter & Organise with Care cannot attend dangerous premises where the building is unsafe or there is a safety threat from people or animals.
We will keep your deposit and send you an invoice for the remaining balance if you have misrepresented the conditions of your property, which would prevent us from carrying out our services.
Access
Declutter & Organise with Care cannot provide our services unless the client/property owner is present, or we have been provided with written authorisation from the client/property owner, granting our representatives to access the premises in their absence.
Third parties
It's possible that we'll occasionally advise you to buy products from a third party, however, please note that we don't operate as a retailer. Operating as your agent, we may buy things for you with your permission. Note that there is a 10% mark up on these goods. You have any legal recourse available to you against the manufacturer, retailer, or both for any flaws or defects with the items.
In the same way, any referrals to third parties for services are based on our expert judgement; we do not, however, warrant or guarantee the goods or services of any third parties we may suggest. You do so under a different and distinct agreement with that provider outside of these terms if you decide to work with a third party that we have recommended.
Donations of Your Property
Declutter & Organise with Care agrees to remove donations with your consent but we can only take one carload. Alternative arrangements at your own cost should be made for excess and heavy items unless charities are available to collect items free of charge. Household waste remains the responsibility of the client.
We will not remove items from your property without your prior consent. Once your discarded items leave your premises, they are no longer considered your property. Please note that donated items are often sold immediately, so it can be difficult to retrieve them.
Please note that any decisions you make over your, or someone else’s, belongings processed during a session, remain your responsibility.
Sales of Your Property
With your authorisation, Declutter & Organise with Care agrees to remove and conduct sales, but our storage offsite is limited to four weeks. We reserve the right to donate unsold items after the four week period; however, you will be given reasonable notice and the opportunity to retrieve any unsold items.
Item sales conducted by Declutter & Organise with Care incur a 50% commission. For items of value greater than $1000 and items that remain at your property, a lesser commission may be arranged.
Please note: it is at our discretion, that we reserve the right to refuse a sale.
Photographs
Your written consent is required for any photographs that may be needed for planning and progress and occasionally, for general marketing (without personal details disclosed).
Booking and Payment Terms
A booking deposit of $110 is required to secure your session. Failure to pay a deposit will lead to cancellation of your session.
For most jobs (excluding NDIS sessions), GST will be added to the final price.
The balance of your session must be paid within 14 days as specified in our invoice.
A minimum of 4 hours is required, unless otherwise agreed. Note that you will still be liable to pay for the agreed time, even if you shorten the session time.
Suburbs further than 30km from Daylesford will be subject to travel charges.
If you are in arrears with payment, we will not provide further service until all payments are up to date. Any additional fees incurred by the debt collection of overdue invoices will be added to your invoice.
Cancellation and Refund Policy
Forty eight hours’ notice is required for all booking cancellations via email or mobile phone communication directly to Declutter & Organise with Care. We are happy to reschedule your appointment and will retain your deposit to secure your new booking; however, if you cancel a booking more than three times, or you do not re-schedule an appointment within 30 days, your deposit will be forfeited.
Failing to provide us with forty eight hours’ notice prior to cancellation, will lead to forfeiture of your deposit and issuance of an invoice for the remainder of the entire session fees, payable within 14 days.
Your booking may be cancelled if we are unable to contact you to confirm a booking.
In the event that your services are redeemable through a gift voucher and you cancel our services without providing forty eight hours’ notice, we will deduct the value of the cancelled appointment from the entitlement contained in the gift voucher.
Although, Declutter & Organise with Care can invoice external funding sources such as NDIS, My Aged Care and other funding, if requested, the onus remains on the client to ensure that funding is available to cover services. Should funding not be provided, the client is responsible for full payment.
